1. Website Use

The Website is provided for general informational purposes and to allow users to learn about our inspection services, request information, schedule services, and make payments when those features are available.

You agree to use the Website only for lawful purposes.

You may not interfere with the Website, attempt to gain unauthorized access, introduce malicious code, or use the Website in a manner that could damage, disable, overburden, or impair our systems.

Information submitted through the Website must be accurate and current to the best of your knowledge.

You may not use the Website to impersonate another person or entity or to submit fraudulent information.

2. Inspection Services

Information on the Website describes services offered by Evergreen & Sage but does not, by itself, constitute an inspection agreement or guarantee that a particular service is available for a particular property.

Actual inspection services are governed by the inspection agreement, scope of inspection, limitations, exclusions, and other documents provided to and accepted by the client before the inspection. If there is a conflict between these Website Terms and a signed inspection agreement concerning an inspection service, the signed inspection agreement controls.

3. Scope and Limitations of Home Inspections

A home inspection is a visual, non-invasive evaluation of readily accessible and observable conditions at the time of the inspection. An inspection is not a guarantee, warranty, code-compliance certification, prediction of future conditions, or substitute for specialized evaluation by an appropriately qualified professional.

Conditions may exist that are concealed, inaccessible, intermittent, outside the scope of the selected service, or not reasonably discoverable during a visual inspection. The absence of a reported defect does not mean that no defect exists.

Inspection services do not replace evaluations by licensed or otherwise qualified specialists, including structural engineers, electricians, plumbers, HVAC professionals, roof specialists, pest professionals, environmental professionals, or other specialists when such evaluation is appropriate.

Additional services such as radon testing, sewer scope, mold or air sampling, water sampling, infrared imaging, moisture testing, or drone-assisted roof observation are subject to the scope and limitations applicable to that service.

Where conditions prevent safe or reasonable access, the applicable component may be excluded or reported as inaccessible or not inspected.

Inspection findings reflect conditions observed at the time of the inspection and may change after the inspection.

4. Estimates, Pricing, and Service Availability

Prices displayed on the Website are subject to change and may vary based on property size, age, location, inspection type, selected add-on services, travel requirements, or other property-specific factors. A price shown online is not necessarily a binding quote until confirmed by Evergreen & Sage.

We reserve the right to correct typographical, pricing, scheduling, or availability errors. We may decline or reschedule a service when necessary because of safety concerns, property access, weather, equipment limitations, scheduling conflicts, or other circumstances outside our reasonable control.

5. Scheduling, Cancellation, and Rescheduling

Appointments are not considered final until confirmed through our scheduling system or directly by Evergreen & Sage. Cancellation and rescheduling terms presented during booking or in the applicable inspection agreement may apply.

If weather, unsafe conditions, lack of access, utility shutoff, occupied conditions, or another circumstance materially prevents an inspection from being performed safely or within the agreed scope, Evergreen & Sage may postpone, limit, or reschedule the inspection.

6. Payments and Refunds

When online payment is offered, you authorize Evergreen & Sage or its designated payment processor to process the amount displayed or otherwise agreed for the selected services. Payment processing may be handled by a third-party payment provider and may be subject to that provider’s terms.

Refunds, credits, cancellation fees, and other payment adjustments are governed by the applicable booking terms and inspection agreement. Unless otherwise stated in writing, payment for services already performed is non-refundable to the extent permitted by applicable law.

7. Reports and Use of Inspection Information

Inspection reports and related photographs, observations, measurements, and test results are prepared for the client and property identified in the applicable inspection agreement. Reports are intended to assist the client in understanding observed conditions and should not be treated as a substitute for specialized professional advice.

Unless authorized in writing or required by law, reports and related materials may not be materially altered, misrepresented, or used to imply that Evergreen & Sage has made a representation beyond the original scope of service.

8. No Warranty

To the fullest extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis. Evergreen & Sage does not warrant that the Website will always be available, uninterrupted, error-free, complete, or current.

Nothing in these Terms is intended to disclaim a warranty or right that cannot lawfully be disclaimed under applicable law.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Evergreen & Sage shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the Website, reliance on Website content, inability to access the Website, or matters outside the agreed scope of an inspection service.

Any limitations of liability applicable to an inspection service are governed by the applicable inspection agreement and are subject to applicable law. Nothing in these Terms is intended to waive or limit liability that cannot legally be waived or limited.

10. Third-Party Websites and Services

The Website may contain links to third-party websites, scheduling platforms, payment processors, mapping services, social media pages, or other services. We do not control and are not responsible for the content, availability, privacy practices, security, or terms of third-party services. Your use of those services may be governed by their own terms and policies.

11. Intellectual Property

The Website and its content, including logos, branding, photographs, graphics, written materials, page design, and other original materials, are owned by Evergreen & Sage or used with permission and are protected by applicable intellectual-property laws.

You may view and print reasonable portions of the Website for personal, non-commercial use. You may not reproduce, modify, distribute, publish, sell, or commercially exploit Website content without prior written permission, except as permitted by law.

12. Privacy

Our collection and use of personal information submitted through the Website is governed by our Privacy Policy. By using the Website, you acknowledge that information may be collected and processed as described in that policy.

You grant Evergreen & Sage permission to use submitted information as reasonably necessary to respond to your request, schedule or perform services, communicate with you, maintain business records, and provide the requested service, subject to our Privacy Policy.

15. Prohibited Conduct

• Attempting to access non-public portions of the Website or another user’s information.
• Using automated systems to scrape or copy Website content in a manner that interferes with Website operation.
• Introducing viruses, malware, or other harmful code.
• Submitting false, misleading, fraudulent, or unauthorized information.
• Using the Website to harass, threaten, defame, or unlawfully harm Evergreen & Sage or another person.
• Using Website content to create a misleading representation about an Evergreen & Sage inspection or service.

16. Changes to These Terms

Evergreen & Sage may update these Terms from time to time. The revised version will be posted on the Website with an updated effective date. Your continued use of the Website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

17. Governing Law

These Terms are intended to be governed by the laws of the State of Idaho, without regard to conflict-of-law principles, except to the extent federal law or other applicable law requires otherwise.

Any dispute relating specifically to Website use shall be handled in a court of competent jurisdiction as permitted by applicable law. Disputes concerning inspection services may be subject to additional dispute-resolution provisions contained in the applicable inspection agreement.

18. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be modified or limited to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in effect to the fullest extent permitted by law.

19. Entire Agreement for Website Use

These Terms, together with any applicable Privacy Policy and other Website policies expressly incorporated by reference, constitute the terms governing your use of the Website. They do not replace or modify a separately executed inspection agreement governing inspection services.
